Developments in telecommunications law and regulation over the past year may rival 1996 in significance. The FCC’s latest Orders on the Universal Service Fund and Intercarrier Compensation will result in massive changes to rules for both wireless and wireline service providers. Indeed, the FCC has commenced a proceeding to sunset the century old circuit-switched telephone network. The continuing push to implement the National Broadband Plan, merger and spectrum sale reviews, and data security and privacy are also hot topics in this evolving and tumultuous field. Further wild cards are the pending challenges to the FCC’s more expansive assertion of jurisdiction and prospects of Congressional action.
